Johnny Depp’s big court win
Johnny Depp just received a big victory in his legal battle against his former wife, Amber Heard, after the Judge ruled against Heard’s dismissal request and stated that Johnny Depp did not receive a fair trial in the UK.
This is the third time that Amber has asked for the case to be dismissed. On this occasion, Amber’s legal team has tried to get the case dismissed on the ground that the UK case ruling should be used as a reference to this case, as both trials have to do with domestic abuse allegations against Johnny Depp and that Mr. Depp received a fair trial.
The Virginian Court Judge, Ms. Azcarate, disagreed and stated that “The Court is not persuaded by Defendant’s argument that plaintiff had a full and fair opportunity to litigate the UK Action.”
The Judge also ruled that the statements made by the Sun and Heard are “inherently different”. The ruling states as follow “The Sun’s interests were based on whether the statements the newspaper published were false”. She continued by adding that “Defendant argues she was in privity with The Sun because they both had the same interest in the case, however, for privity to exist, Defendant’s interest in the case must be identical with The Sun’s interest such that The Sun’s representation of its interest is also a representation of Defendant’s legal right”
She continues by stating that “The Sun’s interests were based on whether the statements the newspaper published wee false”.
The Judge also made it clear that the actress was not even named a defendant in the UK trial adding “The defendant was not part in the UK action and was not treated as one.” She continues “Because she was not named a defendant, she was not a subject to the same discovery rules applicable to named parties.”
The trial is set to go ahead early next year.
